Statements Conducing to Public Mischief

This section penalizes individuals who make, publish, or circulate false statements, information, rumors, or reports, including through electronic means, with malicious intent or effects that disrupt public peace, incite hatred, or cause harm.

Offences and Punishments

1. False Statements Causing Mutiny or Public Fear

Whoever, with intent or likelihood, causes any officer, soldier, sailor, or airman to disregard duty, or induces fear or alarm among the public, or incites class/community offences, shall face:

  • Imprisonment for up to 3 years.
  • A fine, or both.

2. False Statements Creating Enmity or Hatred

Making or circulating false reports to promote enmity, hatred, or ill-will between groups based on religion, race, language, caste, or community shall result in:

  • Imprisonment for up to 3 years.
  • A fine, or both.

3. Offences in Places of Worship or Religious Assemblies

Committing the above offences in places of worship or during religious ceremonies incurs harsher penalties:

  • Imprisonment for up to 5 years.
  • A fine.

Exception

No offence is committed if the statement or information was made in good faith, with reasonable grounds to believe it to be true, and without malicious intent.
